Definitions
"Bank Negara Malaysia website" is the interactive on-line service operated by Bank Negara Malaysia ("BNM") on the World Wide Web of the Internet, consisting of information services and content provided by BNM, affiliates of BNM and other third parties. "Subscriber" means each person who establishes or accesses a connection ("Account") for access to and/or use of Bank Negara Malaysia website.

General
(A) This Agreement, sets forth the terms and conditions that apply to use of BNM website by Subscriber. By using BNM website (other than to read this Agreement for the first time), Subscriber agrees to comply with all of the terms and conditions hereof. The right to use BNM website is personal to Subscriber and is not transferable to any other person or entity. Subscriber is responsible for all use of Subscriber's Account (under any screen name or password) and for ensuring that all use of Subscriber's Account complies fully with the provisions of this Agreement. Subscriber shall be responsible for protecting the confidentiality of Subscriber's password(s), if any.

(B) BNM shall have the right at any time to change or discontinue any aspect or feature of BNM website, including, but not limited to, content, hours of availability, and equipment needed for access or use.

Changed Terms
BNM shall have the right at any time to delete, change or modify the terms and conditions applicable to Subscriber's use of BNM website, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means of, including, but not limited to, posting on BNM website, or by electronic or conventional mail, or by any other means by which Subscriber obtains notice thereof. Any use of BNM website by Subscriber after the issuance of such notice shall be deemed to constitute acceptance by Subscriber of such deletions, changes, modifications or additions.

Equipment
Subscriber shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of BNM website and all charges related thereto.

Subscriber Conduct
(A) Subscriber shall use BNM website for lawful purposes only. Subscriber shall not post or transmit through BNM website any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, an invasion of privacy , vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without BNM's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a Subscriber that in BNM's view restricts or inhibits any other Subscriber from using or enjoying BNM website will not be permitted. Subscriber shall not use BNM website to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with BNM website.

(B) BNM website contains material subject to the protection of copyright, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of BNM website are subject to copyright as a collective work under the Malaysian copyright and trade marks laws. BNM owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. Subscriber may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Subscriber may download material for Subscriber's personal use only provided that this not for the purpose of private or commercial gain. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of BNM and the relevant copyright owner. In the event of any permitted copying, redistribution or publication of material subject to copyright, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. Subscriber acknowledges that it does not acquire any ownership rights by downloading such material.

(C) Subscriber shall not upload, post or otherwise make available on BNM website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with Subscriber. Subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of BNM website, Subscriber automatically grants, or warrants that the owner of such material has expressly granted BNM the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. Subscriber also permits any other Subscriber to access, view, store or reproduce the material for that Subscriber's personal use. Subscriber hereby grants BNM the right to edit, copy, publish and distribute any material made available on BNM website by Subscriber.

(D) The foregoing provisions of this Section 5 are for the benefit of BNM, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

Monitoring
BNM shall have the right, but not the obligation, to monitor the content of BNM website, to determine compliance with this Agreement and any operating rules established by BNM and to satisfy any law, regulation or authorized government request. BNM shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on BNM website. Without limiting the foregoing, BNM shall have the right to remove any material that BNM, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

Indemnification
Subscriber agrees to defend, indemnify and hold harmless BNM, its affiliates and their respective directors, officers, employees and agents from and against all loss, damage, claims or expenses, including attorneys' fees, arising out of the use of BNM website by Subscriber or Subscriber's Account.

Termination
Either BNM or Subscriber may terminate this Agreement at any time. Without limiting the foregoing, BNM shall have the right to immediately terminate Subscriber's Account in the event of any conduct by Subscriber which BNM, in its sole discretion, considers to be unacceptable, or in the event of any breach by Subscriber of this Agreement. The provisions of this Section 8, Sections 5(B), 5(C), 5(D), 7, 9 and the Disclaimer shall survive termination of this Agreement.

Name and Emblem of BNM
The emblem of Bank Negara Malaysia, or the name of Bank Negara Malaysia, including any abbreviation of its name, is protected by the Emblems and Names (Prevention of Improper Use) Act, 1963. Therefore, BNM , BNM website and the BNM emblem, can not be used by Subscriber or any person without the written permission of the Minister. All other trademarks appearing on BNM website are the property of their respective owners.

Third Party Content
BNM is a distributor (and not a publisher) of content supplied by third parties and Subscribers. Accordingly, BNM has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, Subscribers or any other user of BNM website, are those of the respective author(s) or distributor(s) and not of BNM. Neither BNM nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose. (Refer to Section 6 above for the complete provisions governing limitation of liabilities and disclaimers of warranty.)

In many instances, the content available through BNM website represents the opinions and judgments of the respective information provider, Subscriber, or other user not under contract with BNM. BNM neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on BNM website by anyone other than authorized BNM employee spokespersons while acting in their official capacities. Under no circumstances will BNM be liable for any loss or damage caused by a Subscriber's reliance on information obtained through BNM website. It is the responsibility of Subscriber to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through BNM website. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice or other content.

Miscellaneous
This Agreement and any operating rules for BNM website established by BNM constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of Malaysia, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.

Introduction
Bank Negara Malaysia ("the Bank") takes your right to privacy seriously and commits to protecting your personally identifiable information ("personal data") in line with the Personal Data Protection Act 2010 and other applicable laws. This Privacy Statement sets out the Bank's approach in handling personal data.

This Privacy Statement applies to personal data collected by the Bank but does not apply to personal data collected by other entities including those owned or controlled by or affiliated to the Bank, individuals that are not employees or agents of the Bank, or websites that are not under the Bank's control.

The Bank may amend this Privacy Statement from time to time. As such, you are expected to read this Privacy Statement each time you wish to provide your personal data to the Bank. Substantial amendments to this policy will be announced on this website.

Purposes and legal basis for processing of personal data
As a central bank, the Bank may need to process your personal data to perform our statutory functions and exercise powers under the Central Bank of Malaysia Act 2009 ("CBA") and other laws as well as for other related purposes including but not limited to -

  • - engagement with the public and stakeholders;
  • - including members of public on the Bank's mailing list upon request;
  • - procurement of goods or services, specifically –
    • - to assess suitability of service provider; and
    • - to enforce the rights and obligations in the contract including making payments and maintaining the list of personnel who carry out the rights and obligations of the service provider;
  • - recruitment and employment;
  • - ensuring security of our premises and systems;
  • - ensuring the safety and well-being of our employees and visitors; and
  • - audit purposes.
The legal basis we rely on for processing of your personal data may be:
  • - your consent;
  • - performance of contract or in order to enter into a contract with you or your employer;
  • - compliance with the Bank's legal obligations;
  • - protection of your vital interests as well as the vital interests of other individuals;
  • - the Bank's performance of statutory duties; or
  • - the Bank's legitimate interests.

Types of Personal Data collected and processed by the Bank
The types of personal data which the Bank may need to process include but are not limited to –

  • - the name, address, contact details, identification number and passport number;
  • - occupation, designation and employer;
  • - details of professional experience and educational qualification;
  • - sensitive or special categories of personal data such as racial or ethnic origin, biometric data and data concerning health;
  • - information relating to criminal convictions and disciplinary proceedings; and
  • - details of shareholdings, business interests and positions.
The Bank will only collect and process personal data to the extent that such personal data is necessary for the relevant purpose.

How Personal Data is collected by the Bank
The Bank may collect personal data directly from you where it is necessary, reasonable or practical to do so. When we collect your personal data, we will inform you how we may use or disclose your personal data unless it is apparent at the point of collection. In some cases, it may be necessary, reasonable or practical for the Bank to collect your personal data from other persons, with or without your knowledge or involvement as part of our statutory functions and for recruitment purposes.

For visitors to the Bank's premises, the Bank may collect personal data prior to entry for identity verification and security purposes. The Bank also operates CCTVs at exterior perimeters and within our premises for safety of the visitors and Bank's employees, crime prevention and crime detection which may collect photo videos or voice recordings of individuals.

Protection of personal data
The Bank ensures the security of your personal data by taking appropriate security measures to preserve confidentiality of your personal data.

In some instances, it is necessary for us to process sensitive or special categories of personal data such as racial or ethnic origin, biometric data and data concerning health as well as criminal data as part of our functions as described above. In such case, we will apply additional care as required by law.

Disclosure of Personal Data to Third Parties
Efforts will be made to prevent your data being made available to third parties. However, we may share personal data with third parties if -

  • - it is provided for in this Privacy Statement;
  • - your consent is obtained;
  • - a service provided requires interaction with a third party, or is provided by a third party on our behalf;
  • - it is pursuant to legal action or law enforcement; or
  • - it is to perform our statutory functions and exercise powers under the law.
The Bank may disclose your personal data to third parties including but not limited to:
  • - financial institutions;
  • - other parties authorised by you;
  • - regulatory and governmental agencies as permitted or required by law, authorised by any order of court or to meet obligations to regulatory authorities;
  • - other central banks;
  • - third party service providers;
  • - past or future employers of the Bank's employees or prospective employees,
within and outside of Malaysia.

Where the Bank appoints a third party service provider to process personal data on behalf of the Bank, the Bank will instruct such third party service provider to only process such personal data for the specific purposes as required by the Bank.

If we disclose any of your personal data to any person, we will require such person to appropriately safeguard the personal data provided to them.

Retention of personal data
It is the Bank's policy to retain personal data for as long as it is necessary for the purpose such personal data was collected, other purposes that are not incompatible with the original purpose and as required by law. Where the personal data is no longer necessary, such personal data will be disposed unless the law requires it to be archived in the public interest.

Data Subject's rights
Under certain circumstances, you may have the right under the law to:

  • - withdraw your consent to the processing of your personal data if we rely on your consent as the legal basis to process personal data;
  • - request for confirmation whether your personal data is being processed by the Bank, a copy of your personal data which the Bank holds and information on the Bank's processing of such personal data;
  • - request the Bank to correct or complete your personal data held by the Bank if it is incorrect, out of date, incomplete or misleading;
  • - request for erasure of your personal data from the Bank's systems and records;
  • - request the Bank to suspend processing of your personal data;
  • - request the Bank to provide you with your personal data in a manner that allows you to transmit such personal data to a third party or, if technically feasible, to directly transmit such personal data to a third party;
  • - object to the Bank's processing of your personal data;
  • - not be subject to a decision based solely on automated processing without human involvement where such decision may produce legal effects or significantly affect you.
  • - complain to the relevant data protection authority about the actions of the Bank that may be in contravention of any data protection law applicable to the Bank's processing of your personal data.
Where the data protection law applicable to the Bank's processing of your personal data does not provide for a right or set out limitations and exemptions which the Bank may rely on, we have the right to deny your request or allow such request at our discretion.

Monitoring System
For security purposes and to ensure that the website of Bank Negara Malaysia (the Bank) remains available to web users, the Bank uses special software programs for monitoring network traffic to identify unauthorised attempts to upload or change information, or otherwise to cause damage to the Bank's server system. These programs collect no information that directly identify individuals, but they do collect information that could help the Bank identifies someone attempting to tamper with its website.

Disclaimer of Warranty; Limitation of Liability
A) Subscriber expressly agrees that use of "BNM website" is at subscriber's sole risk. Neither BNM, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that BNM website will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of BNM website, or as to the accuracy, reliability or content of any information, service, or merchandise provided through BNM website.

B) BNM website is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability fitness for a particular purpose, accuracy, timeliness or completeness, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

C) This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence or other tortious behaviour, or under any other cause of action. Subscriber specifically acknowledges that BNM is not liable for the defamatory, offensive or illegal conduct of other subscribers or third-parties and that the risk of injury from the foregoing rests entirely with subscriber.

D) In no event will BNM, or any person or entity involved in creating, producing or distributing BNM website or the BNM website software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use BNM website. Subscriber hereby acknowledges that the provisions of this section shall apply to all content on BNM website.

E) In addition to the terms set forth above neither, BNM, nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within BNM website, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Neither, BNM, nor its affiliates, information providers or content partners warrant or guarantee the timeliness, sequence, accuracy or completeness of this information. Additionally, there are no warranties as to the results obtained from the use of the information.

(F) Reference to any specific commercial product, process or service by trade name, trade mark, manufacture or otherwise by BNM or its affliates does not constitute an endorsement, a recommendation or a favouring by BNM.

Bank Negara Malaysia Museum and Art Gallery reserves the right to refuse entry to visitors if they are found violating the rules. Following proper museum etiquette helps ensure that all visitors will have a meaningful experience while at the museum.

Touching
Avoid touching the artwork/artefacts exhibited in the galleries as it may damage the value of the artwork/artefacts.

Food and beverages
Food and drinks should only be consumed at the Museum Café or at the designated area outside the museum building.

Security
Bags may be subject to inspection. All bags are not allowed in the galleries and lockers are available with a RM10 deposit which is refundable.

Lost and found
Items found in the museum should be immediately handed to the museum counter or to any security personnel on duty. Lost items will be kept for one month before they are destroyed. Please contact us at +603 9179 2784 for any enquiries regarding a lost item.

Photography and Video
Photography and videography are only allowed for non-commercial purposes. Camera flashes should not be used in the Art Gallery. Special permission is required for any other types of shoot.

Noise
Please speak softly while in the museum to fully appreciate the exhibition and in consideration of the other visitors.

Accessibility
All galleries and facilities are accessible for wheelchair and stroller users. Wheelchairs and strollers are available for loan at the museum counter located at the Ground Floor.

Dress code
Visitors are advised to dress appropriately and are discouraged from wearing rubber or slippery footwear to avoid slipping. Suitable clothing for an air-conditioned building is advisable.

Playing
Please avoid running, pushing and boisterous activities to prevent falling on to the artworks/artefacts. Young children should be accompanied by adults at all times.

Pets
Pets are strictly not allowed in the Sasana Kijang premises.
